We size by concurrent use, not by headcount. What matters is how many of your people are working in it at the same moment, and how hard they work it. A 40-person firm with a dozen heavy users needs more capacity than a 40-person firm with three occasional ones. We work that out with you before quoting.

No. The dedicated server lives in our Portland data center. You pay the monthly fee and the one-time onboarding, and everything else is on us.
